  • Do I need to hire a legal professional for my real estate transaction?
    If you lack significant experience in real estate transactions, don't speak Spanish fluently, or aren't familiar with legal paperwork, it's advisable to hire a legal professional. This will offer peace of mind, knowing that a professional is overseeing your real estate investment.
  • What are examples of legal issues in a property?
    Sometimes, owners have restricted or limited ownership. Examples include properties with existing mortgages; sales involving only one of several co-owners; cases where the seller is a usufruct holder (can use and benefit from the property but cannot transfer ownership rights); a widow wanting to sell a property belonging to her late husband without a Will, among other scenarios. We will review the legality and sufficiency of the documentation, perform a Title search, obtain certificates of no liens, certificates of no debt, and ensure everything is in legal order for the ownership transfer.
  • What is a Notario Publico and why is it different than in the U.S. or Canada?
    In Mexico, a Notario Publico, unlike their U.S. counterparts, has far greater responsibilities and requires more legal credentials. They are qualified lawyers invested with public faith by the State to certify and provide legality to the public deeds signed before them. After the signature, the Notario must facilitate registrations with the cadastral office and public registry to authorize the Title. Notarios in Mexico also manage taxes by overseeing the Sellerā€™s capital gains tax and the Purchaserā€™s acquisition tax.
  • How is your service different from the one provided by a Notario?
    Our expertise lies in reviewing your case, providing legal guidance to protect your real estate investment, and preparing the file before it reaches the notarization phase. We aim to provide you with a solid foundation for your file to facilitate a smoother experience for all parties involved, minimizing time, cost, and providing client-oriented service. We are not involved in the notarization phase.
  • Do I need to be present in Mexico at closing?
    If you are unable to be physically present in Mexico to sign the deed on closing day, it is possible for you to grant a Power of Attorney (POA) to a person who will be in Mexico to sign at the Notaryā€™s office on your behalf. The POA is to be granted before a Notary in Mexico, or before a Consul in a Mexican Consulate outside Mexico. At this point, DocuSign or other electronic signatures are not an acceptable signing method to transfer ownership of real estate.
  • Do you have a general fee?
    Yes. Once we understand the specifics of your transaction, we can provide a clearer understanding of the applicable services and associated costs. Our fees are tailored to the requirements of each case. Please note that the Notario's fee is separate from our service fee. Many of the documents we obtain for your file are essential for the Title processing, ensuring you won't incur duplicate costs. By providing a complete, verified, and ready-to-start file to the Notary, you can significantly reduce both time and expenses. This thorough preparation is highly valued by Notarios and contributes to a smoother and more efficient transaction.
